Taiwan EPA announces a proposal aimed to update the provisions under the Regulation of New and Existing Chemical Substances Registration, TCSCA. Major amendments include:

• harmonizing the information requirements for different tonnage bands between the EPA and the Ministry of Labour.
• clarifying the quantity that triggers the obligation of the existing chemical substance phase 1 registration.
• ensuring the consistency of the period of the confidential business information (CBI).
• requiring annual report of the new and existing chemical substance registered and approved.
• indicating the calculation of the review period and the extension of the period of supplementation and correction.
• accepting the written appeal with stated reasons for which the registrant may have concerns over the review result.

This proposal is open for comment and public hearings will be held for stakeholder consultation. WTO TBT notification is also scheduled for further comments.

The Toxic Chemical Substances Control Act (TCSCA) was amended and promulgated on December 11, 2013. Pursuant to TCSCA, the subordinate implementing law “Regulation of New and Existing Chemical Substances Registration and Management” were enacted on December 11, 2014.

Earlier in April and June, two other proposals of consumer product GHS labeling and TCSCA amendment, respectively, were notified to WTO TBT.  Legal process is ongoing.
