According to the OSH Act, Taiwan MOL requires the manufacturers, importers, and the suppliers fulfill the responsibility of hazard communication. Prior to providing the hazardous chemicals to business entities or self-employed workers, the manufacturers, importers, or suppliers shall label the hazardous chemicals and provide safety data sheets (SDS). The hazard communication aligning with UN GHS will come into full implementation for not only chemical substances but also mixtures by the end of 2017.

To withhold information from disclosure, for the necessity of national security or trade secret protection purposes, MOL now accepts the information protection application in compliance with the OSH Act.  Eligible applicant may make application to withhold the name and concentration of hazardous chemical ingredients, and the name of manufacturer, importer or supplier from disclosure on SDS and label. If the applicant is a foreign entity, a Taiwan based representative should be assigned for the application process. Application window opens on September1st, 2016. To claim confidentiality protection, an applicant must provide document evidencing such information is trade secret, assessing the economic interest in the information, describing the counter measures undertaken, as well as the proof regarding the hazard property.

However for hazardous chemical ingredients classified as follows, withholding information is not allowed.

1. Acute toxicity category 1, category 2, or category 3;

2. Skin corrosion/irritation category 1;

3. Serious eye damage/eye irritation category 1;

4. Respiratory or skin sensitization;

5. Germ cells mutagenicity;

6. Carcinogenicity;

7. Reproductive toxicity;

8. Specific target organ systemic toxicity -- single exposure category 1

9. Specific target organ systemic toxicity-- repeated exposure category 1

公告事項：
一、為提供更便捷之申辦管道，製造者、輸入者或供應者申請保留揭示安全資料表中之危害性化學品成分之名稱、含量或製造者、輸入者或供應者名稱時，得依本公告事項二網站所公布之資料格式及網路傳輸方式辦理。
