TCSCA – The 5th revised Toxic Chemical Substances Control Act in Taiwan has been promulgated on Dec,11,2014
Article 7-1:
Those manufacturing or importing new chemical substances shall apply to the central competent
authority for chemical substances information registration 90 days prior to commencement of
manufacturing or import.
Compulsory Registrations for Imported Toxic Chemicals
- The revisions to the Toxic Chemical Substances Control Act will require manufacturers or importers of new & existing chemicals to register certain information with the EPA. Depending on tonnage & use, this includes information on the circumstances of the manufacture/import of the chemicals, their physical forms, their chemical compositions, toxicities and exposures. and hazard assessments. There are 3 types of registration: small quantity registration, simplified registration and standard registration
- Any substance which is not listed in the existing substance inventory will be considered as New Substance.
- According to the Article 2 of registration regulation, a registrant may appoint a representative to apply for the chemical substance registration. Foreign companies as a result of confidential considerations have to ask their agents or importers to entrust a Third Party Representative(TPR) (as OR function of EU REACH) for implementing registrations of new and existing substances

REACH
REACH - Are You ready ?
REACH - the new European chemicals regulation is valid since June, 1st, 2007.
REACH stands for:
| Registration |
All chemicals that are imported into the European Union in annual amounts larger than 1 ton per enterprise have to be registered (new and existing chemicals).
The deadline for registration depends on the tonnage and starts in 2010.
However pre-registration is due already by the end of 2008! |
| Evaluation |
The risk associated with different applications of substances over the entire life
cycle must be evaluated, and in the case of chemicals >10 t/a a chemical
safety report has to be established. |
Authorization
and Restriction |
Substances of very high concern must be authorized under REACH and their
use may be subject to restrictions. This applies to carcinogenic, mutagenic,
reprotoxic, persistent or bio-accumulative substances. |

Affected by REACH are chemicals and chemical preparations. Articles are also
concerned, if they release chemicals under normal or reasonably foreseeable
conditions (e.g. ink cartridge). |
You are affected by REACH, if
• you export chemicals, chemical preparations and articles into the EU
• you import chemicals, chemical preparations and articles into the EU, because some chemicals
may no longer be available or become more expensive
You should start preparatory work for REACH immediately:
• Generation of an inventory of all substances (also used in preparations and articles)
• Assessment of the supply chain (manufacturers, importers, downstream users)
• Identification of chemicals which are affected by REACH
• Data collection for affected chemicals
• Portfolio assessment of all substances affected by REACH including the financial implications
• Prepare pre-registration for 2008
